AGREEMENT NUMBER 002 OF 2010

Whereby the Teaching Regulations of the NAVARRA UNIVERSITY FOUNDATION - UNINAVARRA- are issued.

(Compiled by the General Secretariat team, within the framework of the "UNINAVARRA EFFICIENT INFORMATION MANAGEMENT" Innovation project, based on the different institutional rules issued by the unipersonal and collegiate authorities according to their competence. Last update: June 01, 2023)

The Provisional Superior Council of the Navarra University Foundation - UNINAVARRA, in exercise of the powers conferred by Decree 1478 and the General Statute, and,

WHEREAS;

 

That by means of the Constitutive Act of August 25, 2010, the Fundación Universitaria Navarra UNINAVARRA was founded,

 

That the Assembly of Constitution organized the Provisional Superior Council to prepare the statutes, regulations and all the documentation required for the application for recognition of legal status of the University Foundation,

 

In accordance with the provisions of Decree 1478 of 1993, the Teaching Regulations of the University Foundation must be issued,

 

That in a meeting held on November 9, 2010, the Provisional Superior Council met and approved the Teaching Regulations,

 

That in merit of the foregoing,

 

AGREES:

 

CHAPTER I

MISSION, VISION, PRINCIPLES, DEFINITION

 

Article 1. Mission. We are a university community of knowledge generation that, with a business and social vision and under the principles of academic excellence, deepens in autonomous learning, production and application of knowledge for the integral formation of Colombians, qualifying them for the exercise of professional, research and social projection activities, being an actor in the scientific, cultural, economic, political and ethical development at a local and regional level with an international vision.

 

ArtArticle 2. Vision. UNINAVARRA in 2020 will be recognized as an efficient and humane Higher Education Institution, consolidated in the region and articulated with national and foreign institutions, leader in the qualification of professionals trained and linked to the real sector. Our academic programs will be recognized as high quality programs and distinguished by their academic and scientific level at the service of the community with social responsibility.

 

Article 3. Principles. The NAVARRA UNIVERSITY FOUNDATION accepts as its own the principles of higher education, as defined in Chapter I, Title I of Law 30 of 1992, and from them defines the following:

 

  1. Autonomy: Understood as the support for self-determination, choice and the capacity to assume responsibilities, which translates into the institution's ability to think for itself, guided by its vision, to govern itself responsibly and to develop the academy based on scientific and cultural knowledge through research, teaching and extension.
  2. Quality: Based on continuous improvement, UNINAVARRA analyzes and satisfies customer needs with fairness, equity and speed.
  3. Responsibility: With the integral formation of people and the understanding of the needs of the communities where UNINAVARRA is present.
  4. Eficiency: All UNINAVARRA activities must be carried out in a timely manner and at the lowest total cost to ensure the achievement of institutional objectives.
  5. Economía: As a guiding principle of expenditure, resources must be managed in a prudent and reasonable manner, allowing for the timely development of missionary activities.
  6. Universality: Respect for the ideologies, principles, beliefs and thoughts of all the actors related to UNINAVARRA in order to promote transdisciplinary and multiverse dialogue that builds reflections and actions for change in society.
  7. Inyougrality: UNINAVARRA's activities will pursue more than one purpose by enabling joint actions among various actors, reducing efforts and improving dialogue and universality.
  8. Inclusions: The mission processes of UNINAVARRA will be oriented to the satisfaction of the training needs while developing the individual and social welfare of all the people of the university community, respecting the social and cultural differences of each person.

 

Article 4. Definition. These regulations regulate the relationship between the NAVARRA University Foundation and its teaching staff, containing the conditions of entry and promotion in the hierarchy, rights, duties, remuneration, incentives and disciplinary regime, according to internal procedures based on the legal order in force for the nature of the institution.

 

CHAPTER II

FUNCTIONS

 

Article 5. Duties of teachers. The professors of the NAVARRA UNIVERSITY FOUNDATION will have teaching, research, social projection and extension functions. In order to be hired, they must demonstrate, in addition to professional university training, experience in teaching and research work, the requirements expressly provided for in these teaching regulations. As part of the faculty, they will be immediately responsible for the teaching activity of the Navarra University Foundation and develop it in coordination with the unit to which the activities under their charge correspond.

 

  1. To contribute, through teaching, to the integral formation of the student.
  2. Contribute their human quality and maturity, their academic competence based on their disciplinary or professional training and experience, as fundamental elements of the teacher-student relationship.
  3. To develop the programming of the subjects under his/her charge in accordance with the regulations in force in the respective unit and to provide timely information on the results of the evaluations to the corresponding Academic Unit.
  4. Academic advising and student support.
  5. Counseling, direction and evaluation of graduate work.
  6. Participation in the preparation, management, execution, evaluation and dissemination of research projects.
  7. Participate in outreach programs.
  8. Participate in academic and scientific communities.
  9. Participation in evaluation activities directly or as a juror or scorer.
  10. Participate in processes of self-evaluation, accreditation and continuous improvement of academic programs.
  11. Participate in educational administration activities.
  12. Participation in updating, qualification and continuing education programs.

 

At the beginning of the academic period, the professors shall agree with the respective dean their work plan, indicating the weekly hours dedicated to each of said activities, in a spreadsheet provided by the Institution. The distribution shall be approved by the Rector and the President.

 

Paragraph 1. The President may provide that any part of the workday of any faculty member(s) may be devoted to the execution of inter-institutional agreements.

 

Paragraph 2. Research activities must comply with UNINAVARRA requirements.

 

Article 6. Functions of career teachers. Career teachers, referred to in these Regulations, also have the following functions:

 

  1. To carry out research and intellectual production activities whose main objectives are the advancement and application of science as a service to society, the development of art, its own scientific progress and that of its students, and the improvement of its teaching.
  2. To participate responsibly in the programs and activities that UNINAVARRA develops for the service of society and in those that it deems necessary for the effective achievement of its objectives.
  3. Collaborate in the development, implementation and review of academic programs, in coordination with other teachers of their academic unit and in accordance with the guidance of immediate directives.

 

CHAPTER III

GENERAL AND SPECIFIC OBJECTIVES

 

Article 7. General purpose of the teaching regulations. The teaching regulations are fundamentally oriented to stimulate and direct the integral development, in the human and professional dimension of the teachers, for the sake of the effective fulfillment of their functions, and the mission, vision and objectives of UNINAVARRA.

 

 

Article 8. Specific objectives of the teaching regulations. In order to achieve adequate working conditions for the proper fulfillment of the mission that corresponds to the teacher in the Institution, the following are the specific objectives:

 

  1. Define the regime of duties and rights that will allow the consolidation of a solid scientific and teaching community, in order to achieve academic excellence.
  2. Organize a system for the classification, selection, recruitment, hiring, evaluation and promotion of teaching personnel.
  3. To strive for a permanent updating and training of the teaching staff, in order to guarantee a high academic qualification.
  4. To institute a system of democratic participation of teachers in the management of UNINAVARRA.
  5. Define the disciplinary regime aimed at preventing conduct contrary to institutional life, preserving academic normality and establishing the sanction regime.

 

CHAPTER IV

GENERAL ASPECTS

 

Article 9. Scope of application. These Regulations apply to UNINAVARRA and are binding without exception to all its faculty; it will be the responsibility of the President, the Rector, the Vice Rectors and immediately of the directors of each Academic Unit to ensure its compliance.

 

Parágrafo 1. For the purposes of the salary scale, these Regulations do not differentiate between the academic activities of undergraduate and graduate teachers.

 

Parágrafo 2. UNINAVARRA will advocate that the teacher of a postgraduate program developed in it, has at least a degree equivalent to that of the respective program.

 

Article 10. Teachers' employment contracts. The Regulations are an integral part of the employment contract that UNINAVARRA enters into with each faculty member, who by signing them agrees to know and comply with them. UNINAVARRA will provide the necessary means to make the text of the Faculty Regulations available to the faculty.

 

Article 11. Teacher. <Article modified by Article 1° of the Agreement 008 June 20, 2017. The new text is as follows:> A UNINAVARRA faculty member is a person who carries out academic activities of teaching, research and extension, and who is assigned to an academic unit or dependency of the University Foundation.

 

Paragraph 1. The teacher who additionally, or temporarily, exercises managerial or simply administrative functions in UNINAVARRA, shall not lose the status of such or the corresponding rights and prerogatives. His immediate superior will agree with him the conditions and extent of his academic activity of teaching and research. This situation must be reflected in his work contract and in his academic agenda.

 

Paragraph 2. For disciplinary purposes, when the alleged misconduct is related to the performance of managerial or administrative functions, the Human Resources Unit or Directorate, or whoever acts in its stead, shall be competent in the first instance to conduct the respective investigation; the second instance shall be exercised by the President of the Institution.

 

When the facts compromise managerial or administrative functions with academic activities of teaching, research and extension, the Human Resources Unit or Directorate or whoever acts in its stead shall be competent in the first instance to carry out the respective investigation; the second instance shall be exercised by the President of the Institution.

 

The disciplinary procedure applicable to the situations mentioned in this paragraph shall be that established in the Internal Labor Regulations.

 

Paragraph 3. In order to assign the directive functions of Dean or Program Director, the Human Resources Department shall issue the respective call, taking into account the qualities required by the General Statute.

 

The period to perform managerial functions as Deans and Program Directors, by UNINAVARRA full-time teachers, will be four years; at the end of this period the respective call must be made, however, those who perform these functions, may participate in it, and may be re-elected. In the event of not being reelected, the faculty member who performed directive functions as Dean or Program Director, will return to his or her main teaching functions at UNINAVARRA or to his or her initial functions.

CHAPTER V

 

RIGHTS AND DUTIES OF TEACHERS

 

Article 12. Rights. These are the rights of UNINAVARRA teachers:

 

  1. Receive treatment in accordance with their human and professional dignity.
  2. To be heard by the institutional instances in case of imputation of disciplinary offenses, and in any case, exercise their right of defense and contradiction and all those that frame the due process. Demand that in the investigations carried out in such cases, the procedures and guarantees indicated in the Statutes and Regulations of UNINAVARRA are fully complied with and that the right to challenge, as appropriate in each case, the decisions adopted is ensured.
  3. To challenge in the terms set forth in the Statutes and Regulations of UNINAVARRA, the decisions adopted regarding competitions, promotions, retirements and evaluations.
  4. To elect and be elected to be part of the institutional authorities, under the terms provided in the Statutes and Regulations of the Foundation.
  5. Access, upon compliance with the requirements defined for such purpose, to incentives and all kinds of distinctions in consideration of their improvement in the professional practice and their human dimension.
  6. Use the academic, administrative and welfare services offered by UNINAVARRA.
  7. Receive timely payment of the remuneration to which they are entitled, in accordance with the statutory, regulatory and labor conditions.

 

Article 13. Rights of career teachers. The Career Teachers referred to in these Regulations also have the following rights:

 

  1. 1. Participate in the promotion processes within the career ladder in accordance with the norms of these Regulations.
  2. 2. Access and enjoy the means, resources and elements available to the Fundación Universitaria Navarra and necessary for the exercise of its research function.

 

Article 14. Duties. The duties of the teachers of the NAVARRA UNIVERSITY FOUNDATION are as follows:

 

 

  1. To fully comply with the Statutes and regulations governing institutional life, exercising their functions in accordance with them and in dependence on the corresponding university authorities.
  2. To develop the subjects assigned by the Institution, transmitting to the students with all the dedication and diligence, all the theoretical and practical knowledge required by the contents of the respective subjects.
  3. To be a committed professional, supportive, responsible, fulfilling his duties, open to change, keeping coherence between the principles he teaches and his attitudes.
  4. To participate in the meetings of the governing bodies of the Institution, seminars and other events to which he/she is summoned or invited, and to collaborate in all matters concerning the best realization of the purposes of the Foundation.
  5. Develop their work during the time necessary for the proper performance of their duties, in accordance with the assigned academic load. To this end, he/she shall remain, according to his/her dedication, at the disposal of the respective teaching units, on the dates and at the times indicated in the Institution's calendars and schedules.
  6. Encourage the personal knowledge of their students, their potential and limitations, through their active participation in the teaching-learning-evaluation process.
  7. To teach with responsible freedom of thought and respect for dissent, within the framework of the objectives, principles and values that inspire the Foundation.
  8. To prepare, present in a timely manner and update the programs of the subjects under his/her responsibility and develop them in accordance with the guidelines established by the respective unit.
  9. Coordinate teaching programs and methodology with other teachers of the subject and related subjects.
  10. Evaluate with objectivity, fairness and equity the academic tests in strict compliance with the relevant regulations.
  11. To perform all other duties related to his/her position, as delegated to him/her by the institutional authorities of the Foundation.

 

Parágrafo.   The teaching staff of the Foundation shall provide the reports required by the institutional authorities of the Foundation regarding the performance of their duties.

 

CHAPTER VI

 

TEACHER CLASSIFICATION, SELECTION AND HIRING OF TEACHERS

 

Article 15. Classification of teachers. UNINAVARRA teachers are classified according to their affiliation, category and dedication, as follows:

 

  1. By their linkage, they may be of:
  • Career.
  • Chair.
  • On probation.
  1. For his dedication:
  • Full time.
  • Part-time.
  • Chair.
  1. By category:
  • Teaching Assistant.
  • Teaching Assistant.
  • Associate Professor.
  • Full Professor.

 

Parágrafo. An applicant teacher is a teacher who is in the first year of employment, which in turn corresponds to the probationary period, in accordance with the provisions of these regulations. The career teacher is the one who has passed this first year and is in one of the categories of the career ladder.

 

Article 16 Career teachers.  Career teachers are those who, after having worked as full-time teachers in the Foundation for a period of one (1) year, and having been satisfactorily evaluated, are in one of the categories of the career ladder.

 

Article 17. Teaching professors. The teaching staff are those teachers hired to work a certain number of hours, for an academic period or less, in teaching, research, extension, that although they do not meet the qualities required to belong to the career staff, UNINAVARRA needs to link for some special circumstance.

 

Article 18. Dedication.   <Article modified by Article 1° of the Agreement 021 of December 16, 2014. The new text is as follows:> The full-time professor will dedicate the entire working day, which is forty-eight (48) hours per week, to the service of UNINAVARRA. The part-time professor will dedicate half of the working day, which is twenty-four (24) hours per week; and, the chair professor will dedicate the number of contracted hours to UNINAVARRA.

 

Paragraph. Part-time contracts may be established for teachers.

 

Article 19. Academic Assignment. It is up to the Academic Council to establish the minimum and maximum number of academic hours per week to be worked by teachers.

 

Article 20. Fundamental requirements. Whoever aspires to be a teacher at UNINAVARRA, in addition to the legal requirements, must possess personal, academic and professional qualities that allow him/her to perform his/her duties in a responsible manner with the Institution, with the students and with society; must not have been judicially sanctioned for an intentional crime, nor disciplined by any authority, and be committed to respect the principles of UNINAVARRA and those of teaching.

 

Article 21. Selection. Whoever aspires to the selection process as a teacher, must accredit:

 

  1. Letter of request.
  2. Resume, according to the form provided by the Fundación Universitaria Navarra.
  3. Authenticated copy of the degree certificates of the required academic degrees.
  4. Applicant's academic proposal.
  5. Certified teaching experience.

 

Parágrafo.The filling of teaching positions may be done through a merit-based competition, which will be regulated by the Superior Council of the University Foundation of Navarra.

Article 22. Committee. For the selection, a Committee will function as follows:

 

  1. The Chairman, who shall preside.
  2. The Rector.
  3. The Head of the Personnel Department, who shall act as Secretary of the Committee.
  4. Faculty Deans.

 

Article 23. Binding. The hiring of a teacher must be done through an employment contract signed by the President of UNINAVARRA, which must contemplate the conditions and place of service, duration, remuneration and all other legal and regulatory circumstances required by the employment relationship.

 

These are general requirements for the linkage:

 

  1. Degree in Higher Education related to the academic area in which he/she intends to be linked.
  2. Valid professional card.
  3. Duly filled out resume.
  4. DAS certificate.
  5. Disciplinary record issued by the competent authority.
  6. University or professional teaching experience in the minimum required by law and the regulations issued by UNINAVARRA.

 

CHAPTER VII

 

TEACHING CAREER AND CAREER LADDER

 

Article 24. Teaching Career. The purpose of the teaching career is to guarantee the academic level of the institution and the stability and promotion of teachers.

 

The teaching career begins once the Academic Council authorizes the applicant's registration in the teaching career ladder.

 

Article 25. The term "teaching hierarchy" is understood to mean the mechanism for classifying teachers according to their academic preparation, teaching and professional experience, academic productivity, recognized merits and performance in terms of assigned competencies.

 

The requirements and conditions for promotion within the teaching hierarchy shall only be of an academic and professional nature. Research and publications, degrees obtained, qualification, updating and improvement courses taken, teaching experience and efficiency, and professional career shall be taken into account.

 

The mere passage of time alone does not generate rights for promotion.

 

Those teachers who are appointed to administrative positions in UNINAVARRA must take into account their time for promotion in the career ladder.

 

Article 26. Categories. For the purpose of promotion and remuneration of full-time professors, the Navarra University Foundation will be governed by the teaching scale, which will include the following categories:

 

  1. Teaching Assistant
  2. Teaching Assistant
  3. Associate Professor
  4. Full Professor

 

Parágrafo 1.  The first contract of a Full-Time teacher shall be for a maximum term of one year, after which time he/she may apply for admission to the career ladder.

 

Parágrafo 2. In order to enter the UNINAVARRA teaching career ladder, it is required at least to have served as a Full Time Professor at the Institution for a term of one (1) year and to have been satisfactorily evaluated by the Teaching Staff Committee in accordance with the special regulations established by the Academic Council.

Article 27. Requirements to become a teaching assistant. In order to be an assistant teacher, it is required to have a degree in undergraduate Higher Education and a specialization in the required area of knowledge, two (2) years of professional and/or teaching experience, and to have been satisfactorily evaluated.

 

Article 28. Requirements to be an Assistant Professor. To be an Assistant Professor it is required to have an undergraduate degree in Higher Education and to be pursuing a master's degree in the area of knowledge required by UNINAVARRA, to have been an assistant professor for at least two (2) years, to have participated in duly proven research work and to have been satisfactorily evaluated.

 

Article 29. Requirements to be an Associate Professor. In order to become an Associate Professor, it is required to have an undergraduate degree in Higher Education and a graduate degree at the Master's level in the required area of knowledge, accredit a minimum of two (2) years of academic experience, three (3) years as an Assistant Professor, have prepared, for such promotion, and presented to peers from other institutions, a work that constitutes a significant contribution to teaching, science, the arts or humanities and have been satisfactorily evaluated.

 

Article 30. Qualifications for tenured faculty. In order to be a Full Professor, it is required to have an undergraduate degree in Higher Education and a graduate degree at the Master's level in the required area of knowledge, accredit a minimum of three (3) years of academic experience, and four (4) years as an Associate Professor. To have elaborated, for such promotion and sustained before counterparts of other institutions, different works that constitute a significant contribution to teaching, science, arts or humanities. To hold a doctoral degree and have been satisfactorily evaluated.

 

Parágrafo1. The Board of Governors shall regulate the cases in which the degree may be waived for persons who demonstrate having made significant contributions in the fields of technology, art or the humanities. In any case, the corresponding teaching experience will be required.

 

Parágrafo 2. The Academic Council will regulate the cases in which it is possible to enter the teaching career of UNINAVARRA, to a category different from that of assistant.

 

Parágrafo 3. For all legal and regulatory promotion purposes, the work prepared by teachers for promotion within the hierarchy must be of a research nature, exclusive for a specific promotion, and must be previously registered in the Research Center and evaluated in relation to the established quality criteria. This work must be approved by the Research Committee before being submitted to the corresponding peers.

 

The presentation of each paper must be made before peers, who will evaluate the paper, preside over the presentation and give their opinion on the quality of the work.

 

For the validity of research, teachers pursuing master's and doctoral studies must be linked to the UNINAVARRA Research Center in accordance with the policy of the institutional research system.

 

Article 31. Registration and Promotion. The Academic Council shall determine the procedures for the enrollment and promotion of academic teachers in the academic hierarchy.

 

The Teaching Personnel Committee shall not carry out any evaluation if the teacher does not previously accredit compliance with the requirements indicated in each category.

 

Article 32. Degrees from foreign institutions of higher education. Professional degrees obtained in a higher education institution must be duly validated by the Ministry of National Education or the authority having such competence. This requirement may be waived in the cases provided by the Academic Council.

 

Article 33. Stability. The teaching staff enrolled in the career ladder has the right to remain in the service during the period of the corresponding employment contract, as long as they do not incur in the causes of

termination of contract established in the Law or in the Regulations and has passed the regular or deficient factors of the previous evaluation.

 

Article 34. Promotion. The Rector shall issue a reasoned promotion resolution for the teaching personnel entitled to it, on an individual basis, in accordance with these regulations and after a reasoned acknowledgement by the Academic Council.

 

Article 35. Distribution of teaching work. The Academic Council will determine the distribution of teaching work for the performance of teaching, research, social projection and extension functions.

Article 36. Categories of professors. For remuneration purposes, the Superior Council shall establish the remuneration scale in accordance with the categories established for career teachers.

 

CHAPTER VIII

TEACHER EVALUATION

 

OBJECTIVES

 

Article 37. Objectives. Teacher evaluation. Teacher evaluation is an ongoing process that specifically has the following objectives:

 

  1. Improve the teacher's performance and the academic level of the program in which he/she works.
  2. Design and execution of institutional and individual improvement plans for teaching, research, extension and educational administration processes.
  3. To provide the Fundación Universitaria Navarra with information that will help it to make decisions regarding the improvement of methodological strategies, qualification, adequacy of resources and the adoption of incentive policies for teachers.
  4. Serve as criteria for enrollment in the career ladder, permanence, promotion and retirement.

 

Article 38. Faculty Committee. The Teaching Staff Committee is created as an advisory body to the President and the Superior Council for the teaching evaluation and for the monitoring and development of the teaching career, in accordance with the aims and objectives of UNINAVARRA and shall be composed of:

 

  1. The President, who shall preside b. The Rector.
  2. The Academic Vice Chancellor or whoever takes his place.
  3. One (1) career faculty member appointed by the Academic Council.
  4. The Head of the Personnel Department, or whoever acts in his stead, who shall act as Secretary.

 

The Committee shall issue its Rules of Procedure.

 

 

 

 

Article 39. Evaluation Periods. Full-time, part-time and professors must be evaluated at least once during each academic period.

 

Article 40. Evaluation Criteria. The following criteria shall be taken into account for the evaluation of the teaching staff:

 

  1. Technicianpedagógics. They comprise the knowledge, techniques and activities necessary to implement the educational work, among others: work planning, methodology used, evaluation, counseling and relations with students.
  2. Performance. Leadership and coordination skills; organizational and planning skills; responsibility, work performance, collaboration, initiative, interpersonal relations and punctuality.
  3. Updating and preparation. Active participation in conferences, seminars, congresses related to the specialty of their academic work; satisfactory participation of not less than 180 hours in refresher, professionalization and qualification courses after the professional degree and not leading to an academic degree; degree obtained during the period of stability of the category.
  4. Academic Production. Development of research projects; technical-scientific product with the qualities required for a work of this nature; final report of a completed research; conferences given by the professor at institutional, national or international level on research results, publications, among others.
  5. Of articles; of books and texts related to their area and specialization; and, publication of other works not related to their specialty.

 

Parágrafo. The evaluation will be carried out by the same teacher, by the students, by the Program Director and by the Dean of the respective Faculty, with instruments defined by the Academic Council. The results of the evaluations will be compared by the Dean of Faculty to assign the definitive value.

 

Article 41. Notification. The Program Director is responsible for notifying the results of the evaluation of the faculty member. The faculty member may request the Faculty Council, within fifteen (15) days following the notification, to review his/her evaluation.

 

 

CHAPTER IX

 

ACADEMIC INCENTIVES, INCENTIVES AND DISTINCTIONS

 

Article 42. Incentives. The purpose of academic incentives is to promote and recognize the academic excellence of teachers. Such incentives may be: Qualification activities, research, reduction of direct teaching, sabbatical periods, distinctions and recognitions.

 

Parágrafo. The Superior Council shall regulate the incentive system.

Article 43. Qualification. All members of the teaching staff shall have the right to participate in academic, humanistic, scientific, technical and artistic updating and improvement programs.

 

For this purpose, the Superior Council will adopt a plan in accordance with the development plans of UNINAVARRA and the needs of the teachers, based on the programs presented by the Faculties.

 

The Academic Council will be in charge of the execution, control, evaluation and revision of the qualification.

 

Parágrafo 1. The qualification plan should define the basic areas of development and establish their priorities, identify and quantify the resource training needs at the different levels and estimate the budget required for their fulfillment.

 

Article 44. Qualification strategies. UNINAVARRA will employ three strategies in particular to meet the qualification needs, namely:

 

  1. The use of its own resources in the organization of seminars, symposiums, congresses, specific courses or working groups around a research project.
  2. Study commissions, economic incentives and exchanges to pursue postgraduate academic programs or to receive in-service training in institutions of recognized academic or scientific prestige.
  3. Participation of teachers in congresses, seminars, symposiums and other activities organized by other institutions that allow teachers to be in contact with scientific, technological, cultural and artistic advances in theoretical or applied fields.

 

Parágrafo 1. The Institution may authorize a commission for teachers who must travel to other cities or abroad for their studies, and in special cases an incentive whose amount will be defined by the Superior Council, upon the recommendation of the Academic Council.

 

Article 45. Requests for qualification. All applications for teacher qualifications must meet at least the following requirements:

 

  1. The area or discipline chosen by the teacher must be expressly included within the General Qualification Plan adopted by the Academic Council.
  2. The application must be approved by the Faculty Council.
  3. The Academic Council shall make a prior study of the recommendation to be addressed to the Superior Council.

 

Parágrafo. To finance the costs of the qualification of its teachers, the Navarra University Foundation will define in the annual budget an item in accordance with the needs presented in the General Plan.

 

Article 46. Research. The Fundación Universitaria Navarra will stimulate scientific, artistic and intellectual activity in a special way and will try, with the resources at its disposal, to generate adequate working conditions that will allow teachers to develop a fruitful task in accordance with the objectives that the Institution has formulated.

 

Research must become a vital core of teaching management in all areas of knowledge. To achieve this objective, UNINAVARRA will define an adequate infrastructure that encourages the researcher's task and facilitates the improvement of the plans it draws up.

 

Parágrafo 1. The Research Unit of the University Foundation will have as its main function the definition and consolidation of research lines.

The main purpose of these lines of research will be to create favorable conditions for the development of research at UNINAVARRA, stimulating qualified teachers and encouraging the formation of new researchers within the teaching and student bodies.

 

Parágrafo 2. UNINAVARRA will adopt the necessary measures to permanently guarantee the existence of a minimum number of full-time researchers, so as to ensure the continuity and permanence of the research work and the influence of the researcher on the teaching work.

 

Parágrafo 3. The Fundación Universitaria Navarra will create institutional communication mechanisms that allow the dissemination of research activities.

 

Article 47. Sabbatical Period. The Superior Council, in accordance with regulations to be issued for this purpose and upon proposal of the Academic Council, may grant Associate and Full-time tenured professors, on a one-time basis, a sabbatical period of up to one (1) year, after completing seven (7) continuous years of service to UNINAVARRA, in order to devote it exclusively to research or to the preparation of books. The parties must sign a contract in which the obligations and rights are stipulated.

 

Article 48. Academic Distinctions. Establish the following academic distinctions for full-time teachers.

 

  1. Distinguished Teacher. This distinction may be granted by the Superior Council, upon proposal of the Academic Council, to a professor who has made significant contributions to science, art or technology. To be worthy of this distinction, it is also required to have at least the category of Associate Professor and to present an original research work, a text suitable for teaching or a work in the artistic field, considered meritorious by an internal or external jury to be appointed by the Board of Governors.
  2. Teacher Laureate. It may be awarded by the Superior Council, upon proposal of the Academic Council, to a professor who has excelled in the national field for his or her multiple and relevant contributions to science, the arts or technology. In order to be awarded this distinction, it is required, in addition, to have the category of Full Professor, to present an original scientific research work, a text suitable for teaching or an artistic work that has been qualified as outstanding by a national jury to be appointed by the Superior Council.
  3. Honorary Professor. The Honorary distinction will be granted by the Superior Council upon proposal of the Academic Council, to the professor who has served for at least twenty (20) years in UNINAVARRA and who has been outstanding for his or her contributions to science, art or technique, or has provided important services in the Academic Direction. To be worthy of this distinction it is also required to be a Full Professor.

 

Article 49. Application for distinction. The Academic Council will formulate the corresponding request to the Superior Council.

 

CHAPTER X

WORK SITUATIONS

 

Article 50.-. Types of Situations. The teacher may be in any of the following employment situations:

 

  1. En the exercise of its functionsThe teacher is in the performance of his/her duties when he/she assumes and exercises the position for which he/she has been hired.
  2. En license: The faculty member is on leave of absence, except for those established by labor law, when, at his/her own request, he/she is authorized to temporarily separate from the exercise of his/her position, in order to dedicate himself/herself to matters outside the Institution, without the right to remuneration, or with the right to it, if the separation is ordered by the President in order to dedicate him/her to other matters in UNINAVARRA.
  3. En commission. A faculty member is on commission when, by order of the University Foundation of Navarra, he/she temporarily exercises activities related to his/her position or related to it, or different ones, in places other than the usual place of work. The Commission will be conferred by the President. The corresponding Resolution must specify its duration, the type of commission, whether or not it is remunerated, and whether or not there is room for the payment of per diem.
  4. En sabbatical period. Full-time professors may enjoy the incentive of a sabbatical period, upon proposal of the Academic Council and approval of the Superior Council. The authorization of the sabbatical period shall be subject to the regulations to be issued by the Superior Council.
  5. Suspended teacher. A teacher is suspended when he/she has been temporarily separated from his/her position for:
    1. The processing of a disciplinary proceeding, if so ordered by the competent authority.
    2. Disciplinary sanction.
    3. Order of competent authority.

 

In such cases the employment contract is suspended and there is no remuneration. The suspension shall be governed by the legal and internal disciplinary rules.

 

CHAPTER XI

ACADEMIC RECORD OF TEACHERS

 

Article 51. Procedure. The Rector shall adopt the norms and procedures for the provision of the information corresponding to this academic record of teachers.

 

Article 52. Falsehood. Any falsehood in the information submitted to the registry will be considered serious misconduct on the part of the person or persons who have provided it or take undue advantage of it and will be punished in accordance with the provisions of the regulations of UNINAVARRA and the current regulations applicable to the case.

 

Article 53. Information system. The Institutional Information System must keep a detailed record of each professor, including by academic period the courses taught, research and publications, and evaluation reports.

 

CHAPTER XII

DISCIPLINARY REGIME, SANCTIONS

 

Article 54. The purpose of the disciplinary regime is to defend the legality, morality, impartiality, responsibility, cooperation and efficiency of the teaching service, through the application of rules that regulate the conduct of teachers and sanction acts that are incompatible with the objectives indicated in these regulations or with the dignity implied in the exercise of teaching.

 

Article 55. Disciplinary liability. The liability arising from disciplinary action brought against a teacher is independent of the civil and criminal liability that such action may give rise to.

 

Article 56. Legality of the misconduct and disciplinary action. No teacher may be sanctioned except in accordance with the rules that existed prior to the act of which he/she is accused, before a competent authority and observing the fullness of the rules of this procedure. The permissive or favorable provision, even if it is subsequent, shall be applied in preference to the restrictive or unfavorable one.

 

Article 57. Right of Defense. In all disciplinary proceedings, guarantees shall be provided for the exercise of the right of defense. This is guaranteed to the accused throughout the entire procedure, which includes all the actions of denunciation, evidence and sanction.

 

The teacher who is the object of an accusation shall have the right to know the report and the evidence submitted to the investigation; to have the pertinent evidence requested; to be heard in a deposition, for which he/she may request the advice of a practicing attorney or his/her association, and to file appeals.

 

Article 58. Alternative dispute resolution mechanisms. In any of the cases of disciplinary offenses, before initiating a disciplinary process, the competent university authority must seek the most peaceful way to solve the conflict generated as a result of the infraction. In this way, it must resort to any of the following mechanisms: mediation, conciliation, amicable composition, transaction, arbitration, community mediator, coexistence promoter.

 

Parágrafo.The Superior Council shall regulate the manner in which this pre-processing stage shall be carried out.

 

Article 59. Statute of limitations for disciplinary action. Disciplinary action prescribes in three (3) years, counted, for instantaneous misconduct, from the day of its consummation and, for those of a permanent or continuous nature, from the performance of the last act. When there are several conducts judged in a single process, the statute of limitations of actions is fulfilled independently for each one of them.

 

Article 60. Disciplinary misconduct. It constitutes disciplinary misconduct and therefore gives rise to action and imposition of the corresponding sanction, the incursion in behaviors provided in these regulations that lead to the breach of duties or overreach in the exercise of their functions, which have harmful effects on the coexistence and trust of the university community, the principles and the development of the objectives of the university. Also constitute disciplinary misconduct, the behaviors regulated as such in the Internal Work Regulations, employment contract and collective agreement or arbitration award.

 

Article 61. Mitigating Circumstances. They are extenuating circumstances:

 

  1. Previous good conduct.
  2. Acknowledge and confess fault in a timely manner and do not mislead.
  3. Attempt, at its own initiative, to repair the damage or compensate for the harm caused before the disciplinary process is initiated.
  4. Having acted from noble or altruistic motives

 

Article 62. Aggravating circumstances. The following are considered aggravating circumstances:

 

  1. Recidivism in the commission of misdemeanors.
  2. Carrying out the act in complicity with other students or University Foundation employees.
  3. Committing the offense by taking advantage of the trust placed in him/her by a superior.
  4. Committing the offense to conceal another.
  5. Shirking responsibility or attributing it to another or others.
  6. Having acted for ignoble or futile motives.
  7. Committing the offense with premeditation.

 

CHAPTER XIII

PENALTIES, APPEALS AND MISDEMEANORS

 

Article 63. Sanctions. Teachers who incur in disciplinary offenses are subject to the following sanctions:

 

  1. Private verbal reprimand without notation on the résumé, for the commission of very minor offenses, imposed by the Dean of the Faculty to which the faculty member is assigned. An appeal may be lodged with the Dean and an appeal may be lodged with the respective Faculty Council.
  2. Written reprimand with notation on the résumé, for the commission of minor offenses decreed by the Faculty Council. In the decision that imposes it, it will be specified that the reinstatement before the Council that imposed it and the appeal before the Academic Council are applicable.
  3. Suspenstemporary promotion in the career ladder or suspension in the exercise of the position for up to two (2) months, for the commission of serious misconduct decreed by the Faculty Council. The decision that imposes the sanction will specify the duration of the sanction, which may not exceed two academic periods. It will also state that a reinstatement before the Council that imposed the sanction and an appeal before the Academic Council are applicable.
  4. Expulsion of the University Foundation, for the commission of serious misconduct imposed by the Academic Council. In the act that imposes the sanction, it will be stated that the reinstatement before the Council that imposed it and the appeal before the Superior Council are applicable.

 

Article 64. Termination of the Contract. The termination of a faculty member's contract shall be based on the grounds established in Colombian law, in the statutes and regulations of the University Foundation, in the collective bargaining agreement, in the agreement or arbitration award, in the Internal Work Regulations and in the employment contracts.

 

Article 65. Serious Misconduct. These are serious misconduct:

 

  1. Unexcused absence for two or more days.
  2. Activities prohibited or incompatible with the exercise of the profession, or with the respect or loyalty due to the University Foundation.
  3. The performance of activities that are incompatible, prohibited, or for which disqualifications for professional practice have been established by the rules of the University Foundation.
  4. Violation of the ethical principles that regulate the teacher-student relationship with regard to the evaluation system, personal treatment, receipt of gifts or remunerative promises.
  5. The falsity or adulteration of the documents that served as the basis for the contract.
  6. The misappropriation or misuse of research papers, texts, articles, works or teaching materials that do not belong to him/her.
  7. The execution of acts of violence that cause damage to the integrity of persons or property of the University Foundation.
  8. Failure to comply with or violation of the duties established in these Regulations and other provisions of the University Foundation.
  9. Detention, without benefit of release for more than thirty (30) days, motivated by an accusation of an intentional crime.

 

CHAPTER IV

DISCIPLINARY PROCESS

 

Article 66. Investigation.   No one may be investigated more than once for the same action or omission constituting a disciplinary offense. Investigation is understood as the culmination of the investigative process.

 

 

 

Article 67. Disciplinary Action. Disciplinary action may be initiated ex officio or at the request of a party and the statute of limitations is five (5) years from the date of the commission of the act, and if the act is continuous, from the date of the last act.

 

Disciplinary action and the application of sanctions will be applicable even if the teacher is not employed by the University Foundation.

 

Article 68. Duty of information. Anyone who becomes aware of a disciplinary infraction shall report it to the competent authority. Failure to do so constitutes a serious offense.

 

Article 69. Preliminary inquiry. Once the infraction is known, a preliminary inquiry shall be initiated within a term of more than eight (8) days, if a disciplinary infraction is inferred, a precise statement of charges shall be issued, which shall be personally notified to the accused in due form.

 

Article 70. Within eight (8) days from the date of notification, the accused may present his or her arguments and provide and request evidence, which must be produced within eight (8) days from the date of the request. Ex officio evidence may be ordered at any stage of the proceedings.

 

Decision, appeals and enforcement. Once the evidentiary term has expired, the competent authority shall issue the corresponding decision and shall order its notification in due form.

 

Against the sanctioning decision, appeals for reconsideration shall be filed before the authority that issued it; the aforementioned appeals shall proceed. Said appeals must be filed in writing within five (5) days following the notification of the decision. The Appeal may be filed directly or as an alternative to the Appeal for Reconsideration.

 

Any decision shall become final five (5) days after its notification, when appeals have not been filed in a timely manner or when the appeals filed have been resolved.

 

Article 72. Proceedings and annulment. When it is considered that a disciplinary decision violates the Statutes or Regulations of UNINAVARRA, the interested party may appeal autonomously to the Superior Council in an Appeal for Annulment, clearly and precisely indicating the rule violated and the concept of the annulment.

 

CHAPTER XV

DECOMMISSIONING

 

Article 73. Proceedings and annulment. Causes. The following are grounds for removal from service:

 

  1. Termination of the contract for just cause.
  2. Termination of the contract by mutual agreement between the parties.
  3. Termination of the contract by unilateral decision, taken in accordance with the legal terms.
  4. Surviving incapacity of the teacher to provide educational service.
  5. The right to a retirement or old age pension under the terms of the labor law.
  6. The cancellation of the professional title by the competent authority, which constitutes a serious offense for the University Foundation.
  7. Those established in the employment contract.
  8. Expiration of the respective stability period subject to the provisions of these regulations for career teachers.
  9. Unsatisfactory rating more than once in the teacher performance evaluation.
  10. Death of the teacher

 

CHAPTER XVI

FINAL PROVISIONS

 

Article 74. Democratic Participation. Faculty members shall enjoy the right to democratic participation in the various collegiate bodies of the Fundación Universitaria Navarra and in accordance with the provisions of its General Statute.

 

Article 75. Ignorance of the Regulations. Ignorance of the regulations may not be invoked as grounds for non-compliance.

 

Article 76. The Higher University Council of UNINAVARRA is responsible for the reform of these Regulations.

 

Article 77. Conflict resolution Problems arising from or in connection with the application of this President and its interpretation shall be submitted to the decision of the Rector, who may submit them to the Superior Council for study in cases where he/she deems it appropriate.

 

Article 78.. This Agreement is effective as of the date of its issuance.
